Common Issues In A Divorce

The most common areas addressed in a divorce are:

  • Children. If a divorce involves children, they will be the priority. Issues to be addressed will commonly include, legal and physical custody, parenting time, child support and the children’s expenses.
  • Equitable distribution. Dividing the marital assets and debts between the two parties is commonly referred to as “equitable distribution.”
    • Property/asset distribution. This includes identifying what property is marital and how it should be distributed between the new households. Marital property can be in the form of any asset created or held by the marital household such as real property, tangible property, pension accounts, stocks and bank accounts.
    • Division of debts and obligations. This involves identifying marital debts and determining an equitable division of those debts between the parties.
  • Alimony. This is also referred to as spousal support. To determine the eligibility for spousal support/alimony payments, an income and need analysis is made, guided by New Jersey law on alimony. There are many other factors that impact alimony, which makes it important for all parties to be well-represented in these negotiations or at trial.
